General Terms & Conditions

These terms and conditions apply to the purchase of goods from Lily Wellington through lily-wellington.com.
Nothing in these terms is to be read as excluding, restricting or modifying the guarantees you have as a consumer under the Consumer Guarantees Act 1993, or your rights under the Fair Trading Act 1986. Where you buy as a consumer, those rights apply regardless of anything written here.
1. The parties

The buyer is the person who places the order. These terms apply to buyers purchasing as consumers.
Lily Wellington uses Shopify as its technical platform. The purchase agreement is entered into between you and the seller named above, not with Shopify.
2. The agreement
The agreement between you and us consists of:
- these terms and conditions;
- the information shown on the product page and in the checkout;
- the order confirmation;
- our Refund Policy and Shipping Policy; and
- any specific written agreement between you and Lily Wellington.
Where these documents conflict, specifically agreed terms take precedence, as long as this does not limit your consumer guarantees.
3. Products and product information
We do our best to give accurate and up-to-date descriptions, images, measurements, material information and other relevant product information.
Colours can appear slightly different depending on your screen, lighting conditions and device settings. This does not limit your rights if the goods do not match the description given before purchase.
Changes to product information do not apply retroactively to an agreement that has already been made.
4. Price and currency
All prices on this store are shown and charged in US dollars (USD). If your card or bank account is held in another currency, your bank converts the amount at its own rate and may apply a foreign transaction fee. Those charges are set by your bank and are not received by us.
Any delivery costs and other additional costs are shown before you complete your order. You are not charged costs that were not disclosed to you before purchase.
We offer free standard tracked shipping on all orders where this is stated on the website and in the checkout. The Priority & Insured Shipping upgrade costs USD 5.95 and is optional.
An order may be dispatched from a fulfilment centre outside New Zealand, in which case customs duties, GST or clearance fees may be payable on import. Those charges are not included in the price shown at checkout and are set by the customs authority and carrier. See our Shipping Policy for details.
5. Order and order confirmation
The agreement becomes binding when you have submitted your order, subject to obvious typing or pricing errors that you understood or should have understood to be errors.
Once we have received your order we send an electronic order confirmation. Please check it and contact us as soon as possible if anything is wrong.
We may refuse or cancel an order if:
- the goods are not available;
- payment cannot be approved;
- the order contains an obvious error;
- we have reasonable grounds to suspect fraud or unlawful activity; or
- we cannot lawfully supply the goods.
If a paid order is cancelled, the amount paid is refunded without undue delay.
6. Payment
The payment methods available are shown at checkout and include Apple Pay, Google Pay and Shop Pay, together with the card types shown at the payment step.
Payment is handled by the chosen payment provider in accordance with that provider's terms. When you pay by card, the amount may be reserved when the order is placed.
We never see or store your full card details.
7. Delivery
Available delivery methods, expected delivery times and any costs are shown before you complete your order. Parcels are carried by NZ Post.
Delivery has taken place when you, or a third party you have designated who is not the carrier, has physically received the goods.
Stated delivery times are estimates given in good faith. If delivery is delayed, we inform you as soon as we have sufficient information. Goods must be delivered within a reasonable time, as required by the Consumer Guarantees Act 1993.
8. Risk of loss
Lily Wellington bears the risk for the goods until they have been delivered to you or to a third party you designated who is not the carrier.
9. Returns
We offer a voluntary 30-day return period for change-of-mind returns: no reason is required in the first 14 days, and from day 15 to day 30 our extended return conditions apply.

This voluntary return period is in addition to your consumer guarantees and does not replace them.
10. Consumer guarantees and faulty goods
Where you buy as a consumer, the goods come with guarantees under the Consumer Guarantees Act 1993 that cannot be excluded. Goods must be of acceptable quality, match their description and any sample shown, and be reasonably fit for any particular purpose you made known to us before buying.
If goods fail to meet a guarantee:
- where the failure can be put right, you may require us to remedy it within a reasonable time; if we fail or refuse, you may have it remedied elsewhere and recover the reasonable cost from us, or reject the goods;
- where the failure is of a substantial character or cannot be remedied, you may reject the goods and choose a refund or a replacement of the same type and similar value, or keep the goods and claim compensation for the reduction in their value; and
- you may also claim compensation for any other reasonably foreseeable loss or damage caused by the failure.
Claims go to support@lily-wellington.com with your order number and a description of the problem. Photos can speed the process up but do not limit your rights.
Where we are responsible for the failure, we cover the necessary costs of remedy, replacement or return.
11. Customer obligations
As a customer you agree to:
- give correct contact, delivery and payment information;
- pay the agreed price;
- be available to receive or collect the goods;
- follow reasonable safety instructions; and
- not use the website for unlawful purposes, fraud, or to interfere with the security of the website.
You are responsible for protecting the login details of any customer account and should contact us if the account may have been misused.
12. Intellectual property
Text, graphics, logos, images and other content on the website belong to Lily Wellington or our licensors unless stated otherwise.
The content may be used for personal, non-commercial purposes. It may not be copied, distributed or exploited commercially without permission, unless such use is permitted by law.
13. Customer reviews and submitted content
If you voluntarily submit a review, a photo or other content, you grant Lily Wellington a non-exclusive right to display and use that content in connection with the store and its marketing.
You keep ownership of the content and confirm that publishing it does not infringe anyone else's rights.
We do not edit a review in a way that gives a misleading impression of your opinion. Where a review has been incentivised in any way, that is disclosed clearly, as required by the Fair Trading Act 1986.
Personal information contained in submitted content is handled in accordance with our Privacy Policy.
14. Third-party services and external links
The website uses services provided by Shopify, payment providers, carriers and other suppliers.
Lily Wellington remains responsible for its own obligations towards you. A reference to a third party does not limit the rights you have against Lily Wellington.
External websites have their own terms and privacy policies. Lily Wellington is not responsible for content on external websites we do not control, except where mandatory law provides otherwise.
15. Privacy

Accepting these terms does not in itself constitute consent to optional cookies, personalised advertising or electronic marketing.
16. Operation of the website and liability
We work to keep the website available and accurate, but we cannot guarantee that technical faults or temporary unavailability will never occur.
Nothing in these terms limits Lily Wellington's liability, or your rights, further than is permitted by law. In particular, nothing here excludes the Consumer Guarantees Act 1993 in respect of consumer purchases.
Lily Wellington is not liable for indirect losses that could not reasonably have been foreseen, except where the law provides otherwise.
17. Events outside our control
Where extraordinary events outside our reasonable control occur, performance may be delayed.
In such cases we inform you and try to limit the consequences. This section does not limit your consumer guarantees in the event of delay, faulty goods or non-delivery.
18. Changes to these terms
We may update these terms when the business, the services or the applicable rules change.
The terms in force at the time your order was placed apply to that order. Later changes do not apply retroactively.
The date at the top of this page shows when these terms were last updated.
19. Governing law and dispute resolution
These terms are governed by the laws of England and Wales, where the seller, USEEMALL LTD, is registered.
This choice of law does not deprive you of the protection of the consumer law of the country in which you live. If you are a consumer in New Zealand, the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 continue to apply to your purchase.
We will always try to resolve any disagreement amicably. Please contact us first at support@lily-wellington.com and give us the chance to put things right.
If a matter cannot be resolved directly, consumers in New Zealand can get free guidance from Consumer Protection (consumerprotection.govt.nz), raise a complaint with the Commerce Commission (comcom.govt.nz), or take the matter to the Disputes Tribunal.
